ARD is a diversionary program that allows people without a criminal record who are charged with a crime to have their charges removed from their record.
This program does not require people to enter a guilty plea or proceed to trial. It is a pre-trial diversionary program. Individuals apply for the program and, if accepted, go through a period of pre-trial supervision. If they are successful in meeting the requirements of the program -- which may include crime prevention classes, paying restitution, performing community service, engaging in recommended drug and alcohol or mental health treatment -- the charges are dismissed and the arrest record is sealed.
In Cumberland County, individuals may engage in ARD for both DUI and non-DUI offenses.
